Punjab has passed a controversial law allowing for anonymous terrorism trials, sparking intense debate over judicial transparency and the potential for executive overreach.
The Punjab Assembly recently enacted the Anti-Terrorism (Punjab Amendment) Bill 2026, introducing a legal framework that allows for terrorism trials to proceed in near-total anonymity. Under this new legislation, key participants in the courtroom—including judges, prosecutors, and witnesses—are permitted to withhold their identities. The law allows for court records to be sealed and proceedings to be conducted without the defendant knowing the specific individuals overseeing their trial or presenting evidence against them.
The passage of this bill occurred following a walkout t the legislation would undergo a review process. When the bill returned to the assembly floor, it remained unchanged, leading to its swift approval. The legislation grants the government power to appoint an anonymous “designated authority” tasked with labeling specific cases as “special security cases,” effectively bypassing traditional transparency standards.
Under the new rules, the identity of the designated authority remains hidden from everyone except the chief justice of the Lahore High Court. This official possesses the power to categorize any terrorism-related matter, or even entire groups of cases, as falling under these special security provisions. Once a case is designated as such, the court uses official titles rather than names for all involved parties. Witnesses may testify using voice-altering technology, and court documents are signed without revealing the identities of the signatories.

Furthermore, the legislation includes a broad provision that allows the executive branch to implement “such other measures as it may deem appropriate.” Critics argue that this creates a dangerous precedent, granting the government unchecked authority to expand its powers without the need for further legislative oversight or public debate.
Legal experts and human rights advocates have raised significant alarms regarding the compatibility of this law with constitutional guarantees of a fair trial.
